NOTICE OF APPLICATION AND ORAL HEARING
APPLICATION TO REVIEW A MARKET RULE AMENDMENT AND TO
STAY THE OPERATION OF THE AMENDMENT
ASSOCIATION OF MAJOR POWER CONSUMERS IN ONTARIO
On February 9, 2007, the Association of Major Power Consumers in Ontario (“AMPCO”) filed with the Ontario Energy Board (“Board”) an application under section 33(4) of the Electricity Act, 1998 seeking the review of an amendment to the market rules made by the Independent Electricity System Operator on January 18, 2007. The amendment is identified as MR-00331-R00: “Specify the Ramping Capability in the Market Schedule” and relates to the ramp rate assumption used in the market dispatch algorithm within the IESO-administered markets (the “Amendment”). The Amendment has an effective date of February 10, 2007. AMPCO has also applied for an order under section 33(7) of the Electricity Act, 1998 staying the operation of the Amendment pending completion of the Board’s review of the Amendment. The Board has assigned the application Board file number EB-2007-0040.

PARTICIPATION
You may participate in this proceeding in one of three ways:
1. You may send the Board a letter of comment. Your letter should include any request to make an oral presentation to the Board, and must be received by the Board no later than February 28, 2007.
2. You may request observer status in order to receive documents issued by the Board in the proceeding. Your request must be made by letter received by the Board no later than Thursday, February 15, 2007.
3. You may request intervenor status if you wish to actively participate in the proceeding. Your request must be made by letter of intervention received by the Board no later than Thursday, February 15, 2007. Your letter of intervention must include a description of how you are, or may be, affected by the proceeding; and if you represent a group, a description of the group and its membership. The Board intends to proceed in this matter by way of an oral hearing.
The Board intends to make cost awards available in this proceeding. You must indicate in your letter of intervention whether you expect to seek costs and the grounds for your eligibility for costs. You must provide a copy of your letter of intervention to AMPCO at the address set out below.
